Checkpoint information such as location and time is often highly publicized in the targeted areas using <a href=\"https:\/\/www.responsibility.org\/end-impaired-driving\/solutions\/prevention\/high-visibility-enforcement\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"High Visibility Enforcement (HVE) (opens in a new tab)\">High Visibility Enforcement (HVE)<\/a> tactics to promote compliance with the law. But, not all agencies and organizations agree with distributing details about sobriety checkpoints as it may enable potentially impaired drivers to avoid the targeted area. For these reasons, there is some debate over the best approach to checkpoints: Advertise or&#160;Surprise?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Publicized DUI Checkpoints: A Deterrent?<\/h2>\n\n\n\n<p>One argument for disclosing location is to protect the agency conducting the checkpoint. Checkpoints were deemed <a href=\"https:\/\/www.casebriefs.com\/blog\/law\/criminal-procedure\/criminal-procedure-keyed-to-weinreb\/the-fourth-amendment-arrest-and-search-and-seizure\/michigan-department-of-state-police-v-sitz\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">legal and constitutional<\/a> by the Supreme Court in 1990; however, publicly announcing them in advance limits their intrusion into people\u2019s lives thus avoiding the possibility of a Fourth Amendment unlawful search issue arising.&#160;&nbsp;<\/p>\n\n\n\n<p>Several national\nagencies strongly recommend the use and publicizing of sobriety&#160;checkpoints.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The National Highway Traffic Administration (NHTSA) recommends highly publicizing upcoming checkpoints, as studies show it increases the deterrent effect and <a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.dot.gov\/files\/810881.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">decreases alcohol-related fatalities by as much as 20 percent<\/a>. &nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The Centers for Disease Control (CDC) also recommends spreading the word about checkpoints to increase the perceived risk of getting caught, thus deterring impaired drivers and adding to the <a href=\"https:\/\/www.cdc.gov\/motorvehiclesafety\/calculator\/factsheet\/checkpoints.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">overall efficacy<\/a> of the use of sobriety checkpoints.&#160;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A Community Preventive Services Task Force (CPSTF) <a href=\"https:\/\/www.thecommunityguide.org\/sites\/default\/files\/assets\/MVOI-AID-Sobriety-Checkpoints.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">review of studies<\/a> evaluated the impact of publicized sobriety checkpoints. Six studies showed an increase ranging from 4 to 32% in the percentage of people in the targeted communities exposed to the \u201cDon\u2019t Drink and Drive\u201d message.&#160;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The National Academies of Sciences Engineering and Medicine in a <a href=\"https:\/\/www.nap.edu\/read\/24951\/chapter\/6\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">2018 report<\/a> writes \u201cStates and localities should conduct frequent sobriety checkpoints in conjunction with widespread publicity to promote awareness of these enforcement initiatives.\u201d&#160;<\/li><\/ul>\n\n\n<center><a href=\"https:\/\/www.scramsystems.com\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" src=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/state-drunk-driving-laws-search.jpg\" alt=\"State Drunk Driving Laws Search Tool\" \/><\/a><\/center>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Are Unannounced DUI Checkpoints Easily Avoidable? <\/h2>\n\n\n\n<p>Historically, law enforcement agencies have preferred the \u201csurprise\u201d strategy for DUI checkpoints. Like many officers, Virginia State Police spokeswoman Sgt. Michelle Anaya feels that notifying the public about checkpoints may allow illegal drivers to <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/wydaily.com\/story\/2017\/10\/06\/sobriety-checkpoints-the-pros-and-cons-of-disclosing-time-location-nws\/\" target=\"_blank\">detour around them<\/a>. \u201cBy providing notice to the public, those that are breaking the law are given the opportunity to potentially avoid a checkpoint.\u201d Missouri Representative Scott Fitzpatrick felt so strongly that checkpoints are too easy for drunk drivers to avoid that he sponsored and passed a bill <a href=\"https:\/\/www.scramsystems.com\/blog\/2017\/05\/missouri-eliminate-funding-dwi-checkpoints\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">effectively eliminating<\/a> their use in that&#160;state.<\/p>\n\n\n\n<p>Even if a sobriety checkpoint is a non-publicized surprise, drivers may still be able to prepare in advance. The <a href=\"http:\/\/fairdui.org\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Fair DUI Flyer<\/a> works on the premise that most states have not outlined exactly what standard of cooperation or adherence is required at checkpoints. This simple state-law specific flyer is placed by the driver in their window from the inside as they enter the checkpoint. The flyer shows the applicable law by which the driver is not required to show ID, speak with law enforcement, or even open their window.&#160;<\/p>\n\n\n\n<p>The crucial element of surprise for sobriety checkpoints was threatened by technology almost a decade ago, and again recently. In 2011 a group of U.S. Senators wrote a letter to smartphone companies asking them to ban apps that would identify drunk driving checkpoints. Several companies complied with the request. With the rise of <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.waze.com\/\" target=\"_blank\">Waze<\/a>, a GPS navigation app that alerts users to traffic issues and police presence, a letter has again been written. New York City police in early February 2019 <a href=\"http:\/\/enewspaper.mcall.com\/infinity\/article_share.aspx?guid=8aad7ce8-fcad-40e8-8e00-517f929d6df0\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">sent a letter to Google<\/a>, the app\u2019s parent company, stating that people who post the locations of sobriety checkpoints may be \u201cengaging in criminal conduct\u201d. Echoing the sentiment of the pro-publicizing checkpoint camp, Waze stated that identifying police locations promoted road safety because drivers were made aware and modified their behaviors. &#160;<\/p>\n\n\n\n<p>Should sobriety checkpoints be publicized or kept undisclosed?
