{"id":5968,"date":"2018-02-01T18:59:24","date_gmt":"2018-02-02T01:59:24","guid":{"rendered":"https:\/\/www.scramsystems.com\/blog\/?p=5968"},"modified":"2021-08-26T11:43:51","modified_gmt":"2021-08-26T17:43:51","slug":"new-report-calls-higher-taxes-lower-bac-reduce-dwi-deaths","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2018\/02\/new-report-calls-higher-taxes-lower-bac-reduce-dwi-deaths\/","title":{"rendered":"Report Calls for Higher Taxes, Lower BAC to Reduce DWI&#160;Deaths"},"content":{"rendered":"<p>In January the National Academies of Sciences, Engineering, and Medicine released <a href=\"http:\/\/www.nationalacademies.org\/hmd\/Reports\/2018\/getting-to-zero-alcohol-impaired-driving-fatalities.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cGetting to zero alcohol-impaired driving fatalities: A comprehensive approach to a persistent problem.\u201d<\/a> The consensus report\u2014produced by an interdisciplinary committee of researchers in public health, medicine, policy, and health sciences and supported by the <a href=\"https:\/\/www.nhtsa.gov\/\" target=\"_blank\" rel=\"noopener noreferrer\">National Highway Traffic Safety Administration<\/a> (NHTSA)\u2014calls for states and the federal government to enact a series of evidence-based measures to reduce drunk-driving deaths and crashes. Among the list: higher taxes on alcohol and resetting the legal BAC for impaired driving to&#160;0.05.<\/p>\n<h2><strong>Drunk driving&#160;\u201c<\/strong><strong>the deadliest and costliest danger on U.S.&#160;roads\u201d<\/strong><\/h2>\n<p>While the uptick in drugged and distracted driving has received the lion\u2019s share of headlines in recent years, alcohol-related traffic fatalities remain one of the most predominant causes of deaths on the nation\u2019s&#160;roadways.<\/p>\n<p>In 2016, on average <a href=\"https:\/\/www.nhtsa.gov\/risky-driving\/drunk-driving\" target=\"_blank\" rel=\"noopener noreferrer\">29 people per day died<\/a> in alcohol-related crashes. In their pointedly direct introductory abstract, the report authors note, \u201cEach alcohol-impaired driving crash represents a failure of the system\u2014whether that is excessive alcohol service, poor road design, lack of effective policies or enforcement\u2014and is preventable with a coordinated, systematic approach across multiple&#160;sectors.\u201d<\/p>\n<p>Several of the report\u2019s recommendations\u2014including <a href=\"https:\/\/www.dwicourts.org\/\" target=\"_blank\" rel=\"noopener noreferrer\">DWI courts<\/a>, treatment for addicted DUI offenders, and <a href=\"https:\/\/www.scramsystems.com\/products\/scram-continuous-alcohol-monitoring\/\" target=\"_blank\" rel=\"noopener noreferrer\">technology-based interventions<\/a> like ignition interlocks\u2014already have wide support, but others that involve policy changes and additional regulations on the alcohol industry may receive a more mixed&#160;response.<\/p>\n<h2><strong>Higher alcohol costs = less binge&#160;drinking?<\/strong><\/h2>\n<p>According to the report, \u201cAlcohol taxes have perhaps the strongest and most consistent evidence base of any U.S. policy for reducing binge drinking, and strong direct evidence shows that higher alcohol taxes reduce alcohol-impaired driving and motor vehicle crash fatalities.\u201d In short, when booze is more expensive, people buy less alcohol and consume fewer drinks in a sitting\u2014meaning that they are less likely to be impaired behind the&#160;wheel.<\/p>\n<p>However, state and federal taxes combined account for just $0.08 to $0.20 of a drink\u2019s costs, and the <a href=\"https:\/\/www.scramsystems.com\/blog\/2017\/12\/will-a-tax-win-for-alcohol-producers-mean-a-loss-for-drunk-driving-efforts\/\" target=\"_blank\" rel=\"noopener noreferrer\">tax reform bill passed by Congress<\/a> in December 2017 reduced the federal excise tax on alcohol to its lowest level since 1950. The report recommends increasing taxes \u201cenough to have a meaningful impact\u201d on the cost of a drink, ensuring that those taxes increase with inflation, and designate the funds from those taxes for activities like sobriety checkpoints and treatment&#160;programs.<\/p>\n<h2><strong>Lower legal \u201cper se\u201d&#160;BAC<\/strong><\/h2>\n<p>Research shows that the risk of a fatal crash more than doubles by the time someone reaches the current drunk-driving limit. In fact, citing laboratory results, the report states that an \u201cindividual\u2019s ability to operate a motor vehicle (including a motorcycle) begins to deteriorate at BAC levels well below&#160;0.05%.\u201d<\/p>\n<p>States are responsible for setting the <a href=\"http:\/\/dui.findlaw.com\/dui-laws-resources\/per-se-dui-laws.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cper se\u201d BAC for driving<\/a>\u2014the blood alcohol concentration at which a person is automatically considered to be driving drunk. However, federal government played a significant role in achieving the current standard of&#160;0.08.<\/p>\n<p>The report calls on both state and federal governing bodies to lower the \u201cper se\u201d BAC for driving\u2014the blood alcohol concentration at which a person is automatically considered to be driving drunk\u2014from 0.08 to 0.05. States are responsible for setting their BAC limit; however, the federal government plays a significant role in incenting a standard by tying it to eligibility for federal highway&#160;dollars.<\/p>\n<p>Since 2013, the National Transportation Safety Board (NTSB) has recommended <a href=\"https:\/\/www.ntsb.gov\/safety\/mwl\/Documents\/2017-18\/2017MWL-FctSht-Impairment-H.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">reducing the legal BAC for drivers from 0.08 to 0.05<\/a>. While <a href=\"https:\/\/www.scramsystems.com\/blog\/2017\/03\/three-states-may-reduce-bac-limit-drunk-driving\/\" target=\"_blank\" rel=\"noopener noreferrer\">several states have considered doing so<\/a>, to date only Utah has passed legislation. That <a href=\"https:\/\/le.utah.gov\/~2017\/bills\/static\/HB0155.html\" target=\"_blank\" rel=\"noopener noreferrer\">state\u2019s new BAC limit<\/a> is set to take effect at the end of 2018, but the tourism and alcohol industries are urging law makers to reconsider their&#160;decision.<\/p>\n<p>The report notes that other countries that have lowered their legal driving BAC have seen alcohol-related traffic deaths drop. Ultimately, the report argues \u201cThe benefits of lowering BAC are on a continuum, but they are enhanced when introduced alongside high-visibility enforcement, sobriety checkpoints, and publicity. The committee concludes that reducing the BAC to 0.05% is an effective strategy and has the greatest potential impact on those at the highest risk of alcohol-impaired traffic&#160;fatalities.\u201d<\/p>\n<h2><strong>Additional DUI policy&#160;recommendations<\/strong><\/h2>\n<p>In total, the report makes more than two dozen recommendations, noting \u201cThere is no one-size-fits-all approach that will solve the problem of alcohol-impaired driving.
