{"id":5806,"date":"2017-06-07T22:43:36","date_gmt":"2017-06-08T04:43:36","guid":{"rendered":"https:\/\/www.scramsystems.com\/blog\/?p=5806"},"modified":"2021-08-26T11:44:11","modified_gmt":"2021-08-26T17:44:11","slug":"canada-cuts-reasonable-suspicion-requirement-dui-breath-tests","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2017\/06\/canada-cuts-reasonable-suspicion-requirement-dui-breath-tests\/","title":{"rendered":"Canada: \u201cReasonable Suspicion\u201d Not Needed for DUI Breath&#160;Tests"},"content":{"rendered":"<p>Starting next year, <a href=\"http:\/\/globalnews.ca\/news\/3380334\/new-impaired-driving-laws-mean-you-could-be-asked-for-a-breath-sample-without-reason\/\" target=\"_blank\" rel=\"noopener noreferrer\">drivers in Canada<\/a> could be required to\u00a0take alcohol breath tests regardless of whether officers have a \u201creasonable suspicion\u201d that they are driving under the influence of&#160;alcohol.<\/p>\n<p>Currently, during a\u00a0DUI checkpoint or\u00a0DUI stops, Canadian police\u00a0ask questions and engage drivers in a conversation to look for signs of impairment. If those signs exist, they can ask\u00a0a driver to submit to a breath test. But starting in\u00a0July 2018, any motorist pulled over for any reason can be asked to provide a breath sample\u2014even if there are no indications of alcohol&#160;impairment.<\/p>\n<h2><strong>New laws target drugged and\u00a0drunk&#160;driving<\/strong><\/h2>\n<p>The change in the country&#8217;s Criminal Code is response to\u00a0Canada\u2019s proposed Cannabis Act, which is likely to\u00a0go into law in just over a year. The act sets the groundwork for the county\u2019s legalization of marijuana, but lawmakers have also used it as an opportunity to overhaul <a href=\"https:\/\/www.scramsystems.com\/scram-international\/ca\/\" target=\"_blank\" rel=\"noopener noreferrer\">Canada\u2019s impaired driving laws<\/a>\u00a0for both drugs and&#160;alcohol.<\/p>\n<p><a href=\"https:\/\/www.canada.ca\/en\/health-canada\/news\/2017\/04\/backgrounder_changestoimpaireddrivinglaws.html\" target=\"_blank\" rel=\"noopener noreferrer\">The act\u2019s mandatory alcohol screening provision<\/a> authorizes \u201claw enforcement officers who have an \u2018approved screening device\u2019 at hand to demand breath samples of any drivers they lawfully stop, without first requiring that they have a suspicion that the driver has alcohol in their body.\u201d The act also includes increased fines and penalties for drunk driving, as well as an increased use of ignition&#160;interlocks.<\/p>\n<h2><strong>End justifies the&#160;means?<\/strong><\/h2>\n<p>The Canadian government notes that \u201cimpaired driving is the leading criminal cause of death and injury in Canada.\u201d The changes in the Criminal Code for impaired driving are meant to make it easier to identify and prosecute drunk drivers. Supporters also believe the change will keep drunk drivers from avoiding penalties due to questions\u00a0about whether an officer had a \u201creasonable\u201d suspicion of impairment before asking a DUI suspect for a breath&#160;test.<\/p>\n<p>But critics are worried that lowering the standards for testing violates drivers\u2019 constitutional rights against unlawful search and seizure. They also argue that allowing officers to breath test drivers without cause is inefficient and could create a slippery slope in reducing due&#160;process.<\/p>\n<p>Canada\u2019s current requirement for breath testing is <a href=\"http:\/\/duijusticelink.aaa.com\/issues\/detection\/sobriety-checkpoints\/\" target=\"_blank\" rel=\"noopener noreferrer\">similar to standards used in the United States<\/a>, so law enforcement agencies and traffic safety advocates on this side of the border are watching the evolution of Canada\u2019s laws with interest.
