{"id":5761,"date":"2017-04-28T16:44:39","date_gmt":"2017-04-28T22:44:39","guid":{"rendered":"https:\/\/www.scramsystems.com\/blog\/?p=5761"},"modified":"2021-08-26T11:44:57","modified_gmt":"2021-08-26T17:44:57","slug":"wi-supreme-court-rules-drunk-drivers-two-cases","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2017\/04\/wi-supreme-court-rules-drunk-drivers-two-cases\/","title":{"rendered":"WI Supreme Court Rules Against Drunk Drivers in Two&#160;Cases"},"content":{"rendered":"<p>Wisconsin has a reputation for leniency when it comes to drunk driving, but two recent decisions by the state\u2019s highest court could make it easier\u00a0to obtain evidence in\u00a0drunk driving cases\u00a0and prosecute impaired&#160;drivers.<\/p>\n<h4><strong>Warrantless blood draws OKed in some&#160;cases<\/strong><\/h4>\n<p>David Howes was unconscious and seriously injured after hitting a deer with his motorcycle in 2013. While investigating the crash, a sheriff\u2019s deputy discovered that Howes had <a href=\"http:\/\/blogs.mprnews.org\/newscut\/2017\/03\/no-warrant-needed-to-draw-blood-from-unconscious-driver-wis-court-rules\/\" target=\"_blank\" rel=\"noopener noreferrer\">three prior convictions for drunk driving<\/a>. Under Wisconsin law, a driver with prior OWIs may not drive with a BAC over 0.02. One of the EMTs who transported Howes\u2019 to the hospital reported a strong smell of alcohol on Howes\u2019&#160;breath.<\/p>\n<p>In the ER, the deputy asked hospital staff to take a blood sample from the still unconscious Howes. The results showed a BAC of 0.11 two hours after the crash. Because he didn\u2019t consent and the deputy didn\u2019t seek a warrant, at trial Howes argued that the blood results weren\u2019t admissible. The trial court agreed, but the state appealed the&#160;decision.<\/p>\n<p>In March the court ruled on <a href=\"http:\/\/www.patc.com\/articles\/2017_wisconsin_v_howes_chapman.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><em>State v. Howes<\/em><\/a>, agreeing with the state that <a href=\"https:\/\/www.law.cornell.edu\/wex\/exigent_circumstances\" target=\"_blank\" rel=\"noopener noreferrer\">exigent circumstances<\/a>\u00a0justified a warrantless blood draw. As such, the results of the test could be used against Howes. The court noted that the time required to investigate the accident and transport Howes to the hospital created a risk that evidence\u2014in this case Howes\u2019 BAC\u2014would be&#160;destroyed.<\/p>\n<p>The decision wasn\u2019t unanimous, however. Two justices argued that because Howes was unconscious, he had no opportunity to give or refuse consent. In addition, the justices felt that the sheriff\u2019s deputy had plenty of time to seek a warrant before asking the hospital to take a sample. Howes\u2019 lawyer plans to appeal to Wisconsin\u2019s ruling to the U.S. Supreme Court, <a href=\"https:\/\/www.scramsystems.com\/blog\/2013\/04\/supreme-court-rejects-warrantless-blood-draws-in-dui-cases\/\" target=\"_blank\" rel=\"noopener noreferrer\">which ruled in 2013<\/a> that a warrant is usually required to draw blood from a suspected drunk&#160;driver.<\/p>\n<h4><strong>Juries can hear about breath test&#160;refusals<\/strong><\/h4>\n<p>Early this month in <a href=\"http:\/\/www.jsonline.com\/story\/news\/blogs\/proof-and-hearsay\/2017\/04\/20\/wi-supreme-court-agrees-drunken-driving-case\/100689616\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>State v. Lemberger<\/em><\/a>\u00a0 the Wisconsin Supreme Court reaffirmed that prosecutors can bring up a DUI suspect\u2019s refusal to take a breath test at&#160;trial.<\/p>\n<p>In 2014, Gary Lemberger was pulled over for what turned out to be his fourth OWI offense. During his trial, <a href=\"https:\/\/www.wicourts.gov\/sc\/opinion\/DisplayDocument.pdf?content=pdf&amp;seqNo=189070\" target=\"_blank\" rel=\"noopener noreferrer\">the prosecutor told the jury<\/a> that Lemberger\u2019s refusal of a breath test after his arrest showed \u201ca guilty conscience\u201d and was \u201cproof positive that [Lemberger] knew he had been drinking.\u201d The trial judge also instructed the jury that they could consider the refused test in their&#160;deliberations.<\/p>\n<p>Lemberger appealed for a new trial, arguing that he had a constitutional right to refuse a breath test and that his refusal couldn\u2019t be presented as evidence of his guilt. But under Wisconsin\u2019s implied consent law, drivers cannot legally refuse a breath test once they\u2019ve been&#160;arrested.<\/p>\n<h4><strong>Questions persist on implied consent, warrantless blood&#160;draws<\/strong><\/h4>\n<p>Wisconsin\u2019s recent rulings reflect the persistent questions and concerns about implied consent and warrantless blood draws. In 2015, thirteen states supported <a href=\"https:\/\/www.scramsystems.com\/blog\/2015\/01\/u-s-supreme-court-wont-revisit-warrantless-blood-draws-duis\/\" target=\"_blank\" rel=\"noopener noreferrer\">a request by Colorado<\/a> to have the U.S. Supreme Court review its 2013 decision on blood draws, but the court declined. Several state courts have struck down warrantless blood draw provisions in \u201cno refusal\u201d and implied consent laws. Wisconsin\u2019s rulings seem to run counter to that trend, and it will be interesting to see if the U.S. Supreme Court revisits the&#160;issue.<\/p>\n<p><a href=\"https:\/\/www.scramsystems.com\/7-leading-trends-in-alcohol-testing-technologies-on-demand-webinar\/?utm_source=sobering%20up&amp;utm_medium=banner&amp;utm_campaign=7%20trends%20webinar\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" src=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/trands-wp-webinar.png\" \/><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Wisconsin has a reputation for leniency when it comes to drunk driving, but two recent decisions by the state\u2019s highest court could make it easier\u00a0to obtain evidence in\u00a0drunk driving cases\u00a0and prosecute impaired&#160;drivers.
