{"id":5524,"date":"2016-09-08T20:26:29","date_gmt":"2016-09-09T02:26:29","guid":{"rendered":"https:\/\/www.scramsystems.com\/blog\/?p=5524"},"modified":"2021-08-26T11:49:06","modified_gmt":"2021-08-26T17:49:06","slug":"tn-could-lose-highway-funding-over-new-dui-law","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2016\/09\/tn-could-lose-highway-funding-over-new-dui-law\/","title":{"rendered":"TN Could Lose Highway Funding Over New DUI&#160;Law"},"content":{"rendered":"<p>When Tennessee\u2019s lawmakers revised the state\u2019s drunk driving laws earlier this year, they didn\u2019t anticipate that one change could cost them as much as <a href=\"http:\/\/www.timesfreepress.com\/news\/politics\/state\/story\/2016\/aug\/30\/tennessee-seeks-avert-60-million-loss-federal-road-fund-over-new-dui-law\/384007\/\" target=\"_blank\" rel=\"noopener noreferrer\">$60 million in federal highway funding<\/a>.<\/p>\n<h3>BAC limits for underage&#160;drivers<\/h3>\n<p><a href=\"http:\/\/www.capitol.tn.gov\/Bills\/109\/Bill\/SB1317.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Tennessee\u2019s Senate Bill 1317<\/a>, which went into effect on July 1, redefined the standards and penalties for underage drunk driving. Previously, drivers under 21 could be cited for impaired driving with a BAC of over 0.02. Under the new law the 0.02 BAC now applies only to 16- and 17-year-old drivers, while drivers 18 and older are considered to be impaired at 0.08 BAC. Drivers under 21 with a positive BAC can still be cited for underage&#160;drinking.<\/p>\n<p>State lawmakers made the change as part of a larger effort to introduce stiffer penalties for all impaired driving. The new law imposes more severe consequences\u2014including higher fines and jail time\u2014on 18- to 20-year-olds who are caught driving&#160;drunk.<\/p>\n<h3>Zero tolerance for underage&#160;drinking<\/h3>\n<p>The bill easily passed in both of the state\u2019s chambers. However, lawmakers say they didn\u2019t realize it put the state out of compliance with federal \u201czero tolerance\u201d requirements for underage drivers. <a href=\"http:\/\/www.nhtsa.gov\/people\/injury\/research\/FewerYoungDrivers\/iv__what_caused.htm\" target=\"_blank\" rel=\"noopener noreferrer\">Zero tolerance laws<\/a>\u2014in place in every state since 1998\u2014are based on the idea that since it is illegal for people under 21 to drink, it should be illegal for people under 21 to drive with any amount of alcohol in their&#160;system.<\/p>\n<p>Zero tolerance laws can allow for up to a 0.02 BAC to account for the differences in testing equipment, but no higher. States out of compliance with the federal standard can lose up to 8% of their federal highway funding\u2014money that most states can\u2019t afford to do&#160;without.<\/p>\n<h3>Misstep\u00a0by a\u00a0leader in DUI&#160;enforcement?<\/h3>\n<p>In recent years <a href=\"https:\/\/www.scramsystems.com\/blog\/2014\/06\/two-progressive-tn-laws-expand-monitoring-non-dui-offenders-mandate-treatment\/\" target=\"_blank\" rel=\"noopener noreferrer\">Tennessee has earned recognition<\/a> for passing a number of new laws aimed at curbing drunk driving, including adding provisions for <a href=\"https:\/\/www.scramsystems.com\/products\/scram-continuous-alcohol-monitoring\/\" target=\"_blank\" rel=\"noopener noreferrer\">electronic alcohol monitoring<\/a> and treatment for repeat offenders. However, this latest law may cause the state more problems than it&#160;solves.<\/p>\n<p>The National Highway Traffic Safety Administration (NHTSA) has given Tennessee until October 1 to bring its law in line with federal requirements. Tennessee officials have asked for a waiver, arguing that the harsher penalties and the totality of the state\u2019s underage drinking laws are in keeping with the spirit of the zero tolerance requirement.
