{"id":4603,"date":"2015-12-23T10:13:29","date_gmt":"2015-12-23T17:13:29","guid":{"rendered":"http:\/\/scramsystems.com\/blog\/?p=4183"},"modified":"2021-08-26T11:45:57","modified_gmt":"2021-08-26T17:45:57","slug":"u-s-supreme-court-to-look-at-penalties-for-refusing-bac-tests-during-dwi-stops","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2015\/12\/u-s-supreme-court-to-look-at-penalties-for-refusing-bac-tests-during-dwi-stops\/","title":{"rendered":"U.S. Supreme Court to Look at Penalties for Refusing BAC Tests During DWI&#160;Stops"},"content":{"rendered":"<p>The U.S. Supreme Court has agreed to hear arguments in <a href=\"http:\/\/www.scotusblog.com\/2015\/12\/court-to-rule-on-drunk-driving-tests\/\" target=\"_blank\" rel=\"noopener noreferrer\">three cases on the constitutionality<\/a> of punishing suspected drunk drivers for refusing to submit to breath or blood alcohol testing when stopped by police. The three cases are <em>Birchfield v. North&#160;Dakota<\/em>, <em>Bernard v.&#160;Minnesota<\/em>, and <em>Beylund v. North&#160;Dakota<\/em>, which will be consolidated and heard&#160;together.<\/p>\n<h3><strong>Implied Consent and No&#160;Refusal<\/strong><\/h3>\n<p>All 50 states have some form of\u00a0<a href=\"http:\/\/dui.findlaw.com\/dui-arrests\/implied-consent-laws.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u201cimplied consent\u201d or &#8220;no refusal&#8221;\u00a0laws<\/a> for motorists, which impose penalties on drivers who refuse to undergo sobriety testing during a DUI arrest or stop. The most common consequence is an automatic license suspension, but 13 states also allow for criminal charges to be filed. And if the person is later found guilty of driving under the influence, some states add on additional consequences during sentencing specifically for the refusal to&#160;test.<\/p>\n<p>The three cases before the court are challenging the constitutionality of implied consent laws under the argument that they violate suspects\u2019 <a href=\"http:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/what-does-0\" target=\"_blank\" rel=\"noopener noreferrer\">Fourth Amendment rights<\/a> against warrantless searches. The North Dakota cases are contesting the imposition of\u00a0criminal punishments for people who refuse warrantless testing.\u00a0The Minnesota case is challenging the\u00a0state\u2019s statute allowing for warrantless testing if police believe there is probable cause that a suspect is driving while&#160;intoxicated.<\/p>\n<p>A DUI suspect\u2019s BAC is often the most important evidence presented in a drunk-driving case. Implied consent laws arose because when drivers refuse sobriety tests, the passage of time can jeopardize BAC readings as the body metabolizes the alcohol. Penalties for refusing a test are intended to encourage drivers to submit in order to save time and preserve&#160;evidence.<\/p>\n<p>But critics argue that the laws shift the onus of collecting evidence and probable cause from police to suspects. In addition, critics claim the laws\u00a0place a substantial burden on defendants by requiring\u00a0them to\u00a0either provide evidence that aids in their own prosecution or automatically face punishment for not doing so\u2014without due process and before they\u2019ve actually been convicted of a&#160;crime.<\/p>\n<h3><strong>Revisiting Warrantless Blood Draws&#160;<\/strong><\/h3>\n<p>Critics of implied consent laws also argue that police already have an effective legal tool at their disposal to compel\u00a0suspects to submit to a BAC test: a&#160;warrant.<\/p>\n<p>In accepting these new cases the court is expected to clarify its <a href=\"http:\/\/scramsystems.com\/blog\/2013\/05\/supreme-court-ruling-on-warrantless-dui-blood-testing-will-burden-court-system\/\" target=\"_blank\" rel=\"noopener noreferrer\">2013 decision in <em>Missouri v. McNeely<\/em><\/a><em>, <\/em>which determined that in most situations police must obtain a warrant before conducting a blood draw on a DUI suspect if the suspect has refused or is unable to cooperate. In that case, the justices found that the body\u2019s metabolism of alcohol does not inherently create exigent circumstances that would allow for a blanket exception to the Fourth&#160;Amendment.<\/p>\n<p>The current cases claim that implied consent laws are an end-run around the Fourth Amendment and violate the high court\u2019s intent in <em>Missouri v.&#160;McNeely<\/em>. Multiple state <a href=\"http:\/\/www.thenewspaper.com\/news\/45\/4545.asp\" target=\"_blank\" rel=\"noopener noreferrer\">supreme courts have already struck down<\/a> their states\u2019 implied consent and no refusal laws in the wake of the 2013&#160;ruling.<\/p>\n<p>Furthermore, earlier this year the court <a href=\"http:\/\/scramsystems.com\/blog\/2015\/01\/u-s-supreme-court-wont-revisit-warrantless-blood-draws-duis\/\" target=\"_blank\" rel=\"noopener noreferrer\">refused to hear a Colorado case<\/a> that would have revisited the<em> Missouri v.&#160;McNeely<\/em> ruling. Based on that decision, some court analysts expect the justices will use the current cases to solidify the requirement for police to obtain a warrant before testing DWI suspects without their&#160;consent.<\/p>\n<h3><strong>License Suspension vs. Criminal&#160;Punishment<\/strong><\/h3>\n<p>While\u00a0the North Dakota defendants are challenging the criminal judgments related to their testing refusals,\u00a0in the Minnesota case the court will look at the defendant\u2019s license suspension. Some observers speculate that the court could differentiate between criminal and non-criminal penalties for refusing a sobriety test, leaving some power with the states while setting up clearer guidelines on suspects\u2019 Fourth Amendment&#160;rights.<\/p>\n<p>Whatever the outcome, the high court\u2019s decision is expected to have far-reaching implications on implied consent laws and to impact\u00a0how law enforcement agencies handle DWI stops and evidence&#160;collection.<\/p>\n<a href=https:\/\/www.scramsystems.com\/clients\/client-voices\/?utm_source=sobering%20up&utm_medium=banner&utm_campaign=client%20voices\" target=\"blank\"><img decoding=\"async\" src=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/client-voices.jpg\"><\/a>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Supreme Court has agreed to hear arguments in three cases on the constitutionality of punishing suspected drunk drivers for refusing to submit to breath or blood alcohol testing when stopped by police.
