{"id":3648,"date":"2015-01-12T16:34:08","date_gmt":"2015-01-12T23:34:08","guid":{"rendered":"http:\/\/scramsystems.com\/blog\/?p=3648"},"modified":"2020-07-10T11:55:46","modified_gmt":"2020-07-10T17:55:46","slug":"proposed-laws-bar-drunk-drivers-buying-alcohol","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2015\/01\/proposed-laws-bar-drunk-drivers-buying-alcohol\/","title":{"rendered":"Proposed Laws Would Bar Drunk Drivers From Buying&#160;Alcohol"},"content":{"rendered":"<h3>Special Licenses Would Prohibit Liquor&#160;Purchases<\/h3>\n<p>For the second time in two years, New Mexico State Representative Brian Egolf has proposed a bill to <a href=\"http:\/\/www.santafenewmexican.com\/news\/local_news\/rep-egolf-proposes-booze-ban-for-dwi-offenders\/article_537c5a46-0922-5966-953e-cdbadcef0793.html\" target=\"_blank\" rel=\"noopener noreferrer\">prohibit convicted drunk drivers from purchasing alcohol<\/a>. The bill\u2014which was defeated in the state\u2019s senate in 2013\u2014would require DUI offenders who are under orders to use an ignition interlock to carry a special driver\u2019s license or identity card noting they are not allowed to buy&#160;booze.<\/p>\n<p>According to the most recent statistics from the <a href=\"http:\/\/www.nhtsa.gov\/NCSA\">National Highway Traffic Safety Administration (NHTSA)<\/a>, alcohol-related crashes account for 30% of all traffic deaths in New Mexico. Currently all convicted DUI offenders in the state must install an ignition interlock in their car. However, the law has roughly a 50% compliance rate. Because so many evade their interlock requirement, Egolf feels prohibiting alcohol sales to people convicted of intoxicated driving would make the roads safer. Egolf recognizes his bill isn\u2019t perfect but he is giving it a second try in hopes of arming the state with another tool to prevent drunk&#160;driving.<\/p>\n<h3>Felony Punishments\u00a0for\u00a0Alcohol Retailers and&#160;Servers<\/h3>\n<p>To the east, the Oklahoma legislature is considering a bill that would not only prohibit convicted drunk drivers from drinking but would also make it <a href=\"http:\/\/www.huffingtonpost.com\/2015\/01\/05\/oklahoma-dui-law_n_6418574.html?utm_hp_ref=politics&amp;ir=Politics\" target=\"_blank\" rel=\"noopener noreferrer\">a felony to \u201cknowingly\u201d sell or give alcohol<\/a> to a person court-ordered to abstain from drinking. Like the proposed New Mexico measure, Oklahoma would issue special IDs marked \u201calcohol restricted\u201d to alert clerks and servers that the person is not allowed to drink. The felony penalty for those who sell or provide alcohol would make the law one of the toughest drunk driving measures in the&#160;county.<\/p>\n<h3>DUI Sanctions&#160;vs.\u00a0Enforcement,\u00a0Costs<\/h3>\n<p>Supporters of these bills claim banning alcohol consumption and purchases are appropriate sanctions for drunk drivers. Many courts already prohibit DUI offenders from consuming alcohol for a period of time and these bills would make that\u00a0practice\u00a0more widespread. Furthermore, the bills would get more of the community involved in preventing drunk driving by making businesses that sell alcohol part of the&#160;solution.<\/p>\n<p>However, opponents question how effective the laws would really be. DUI offenders could enlist a friend or family member to purchase alcohol for them, and many retailers and restaurants do not card patrons who appear to be over 21. In addition, there are concerns about the anticipated costs\u00a0to\u00a0design a new license type and to\u00a0enforce the laws.
