The exact requirements of the laws vary from state to state. In some, implied consent refers only to field sobriety tests, while in others it includes blood, breath, or urine testing. In 11 states, refusing to comply can lead to criminal&#160;charges.<\/p>\n<p>In the 2013 case of <a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/missouri-v-mcneely\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Missouri v. McNeely<\/em><\/a>, the U.S. Supreme Court determined that <a href=\"http:\/\/scramsystems.com\/blog\/2013\/05\/supreme-court-ruling-on-warrantless-dui-blood-testing-will-burden-court-system\/#.VBHfOqPnaUk\" target=\"_blank\" rel=\"noopener noreferrer\">states must obtain a warrant<\/a> before administering a blood test for alcohol, regardless of their implied consent laws. The court ruled that a blood test fell under the Fourth Amendment\u2019s definition of a \u201csearch.\u201d The decision also noted that the fact that alcohol is metabolized by the body\u2014thereby giving law enforcement a short window to test a suspect\u2014does not in itself equate to\u00a0exigent&#160;circumstances.<\/p>\n<p>Now, the Minnesota Supreme Court is <a href=\"http:\/\/www.startribune.com\/local\/274014721.html\" target=\"_blank\" rel=\"noopener noreferrer\">reviewing that state\u2019s implied consent law<\/a>. In part, the court is being asked to consider whether individuals can be subject to criminal charges and imprisonment for withholding consent to DWI testing\u2014or in other words, for refusing a search. The defense is arguing that the right to refuse a search is protected under the Constitution and the state cannot make it a crime to invoke a Constitutional right. Instead, the defense claims the state can\u00a0impose civil penalties for refusing a test, such as revoking the suspect\u2019s driver\u2019s&#160;license.<\/p>\n<p>Many law enforcement officials and anti-drunk-driving organizations view implied consent laws as a key tool to prosecuting impaired drivers and keeping the roads safer. But opponents argue that those efforts can\u2019t, and don\u2019t have to, infringe on a suspect\u2019s rights. The <a href=\"http:\/\/scramsystems.com\/blog\/2013\/12\/minnesota-supreme-court-look-necessary-drunk-driving-defense\/#.VBBig6PnaM8\" target=\"_blank\" rel=\"noopener noreferrer\">Minnesota Supreme Court<\/a> is expected to issue its ruling in a few&#160;months.<\/p>\n<script src=\"\/\/fast.wistia.com\/embed\/medias\/ojajw15ar7.jsonp\" async><\/script><script src=\"\/\/fast.wistia.com\/assets\/external\/E-v1.js\" async><\/script><span class=\"wistia_embed wistia_async_ojajw15ar7 popover=true popoverContent=link\" style=\"display:inline\"><a href=\"#\"><img decoding=\"async\" src=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/scram-cam-product.jpg\"><\/a><\/span>\n","protected":false},"excerpt":{"rendered":"<p>All 50 states have implied consent laws, which state that by having a license drivers\u00a0agree to alcohol testing in the event of being suspected of DWI.
