{"id":2591,"date":"2013-06-27T18:13:00","date_gmt":"2013-06-28T00:13:00","guid":{"rendered":"http:\/\/alcoholmonitoring.com\/blog\/?p=2591"},"modified":"2016-02-18T07:47:02","modified_gmt":"2016-02-18T07:47:02","slug":"ntsb-05-bac-recommendation-stirs-controversy-in-dui-community","status":"publish","type":"post","link":"https:\/\/www.scramsystems.com\/blog\/2013\/06\/ntsb-05-bac-recommendation-stirs-controversy-in-dui-community\/","title":{"rendered":"NTSB .05 BAC Recommendation Stirs Controversy in DUI&#160;Community"},"content":{"rendered":"<p>In the weeks since the <a href=\"http:\/\/www.ntsb.gov\/doclib\/reports\/2013\/SR1301.pdf\">National Transportation Safety Board (NTSB)<\/a> submitted a recommendation to lower the legal BAC limit for drivers from 0.08 to 0.05 BAC, commentary from politicians, lobbying groups, the media, and the general public has been&#160;wide-spread.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-thumbnail wp-image-1947\" src=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/2012\/11\/imagesCA6LQZZH-150x150.jpg\" alt=\"imagesCA6LQZZH\" width=\"150\" height=\"150\" \/>The general consensus is that alcohol-related accidents are still far too frequent in the U.S.: over 1.4 million Americans are arrested each year for driving while impaired and 9,878 people were killed in drunk driving accidents in&#160;2011.<\/p>\n<p>But that\u2019s where the agreement seems to end. The NTSB\u2019s recommendation has received resistance from groups as diverse as <a href=\"http:\/\/www.madd.org\/media-center\/\">Mothers Against Drunk Driving (MADD)<\/a>,\u00a0 <a href=\"http:\/\/abionline.org\/targeting-the-wrong-drinkers\/\">American Beverage Institute<\/a>, law enforcement agencies and law-makers. Here are some of the critics\u2019 arguments against lowering the drunk-driving&#160;BAC:<\/p>\n<ul>\n<li><b>It targets \u201cresponsible\u201d drinkers rather than addressing the real problem: hardcore and repeat drunk&#160;drivers.<\/b> The NTSB points to research showing even a 0.05 BAC raises the risk of a crash; however, critics state that the majority of alcohol-related road fatalities involve drivers with BAC levels well above the current legal&#160;limit.<\/li>\n<li><b>The message should be \u201cno BAC\u201d rather than a lower&#160;BAC.<\/b> Some argue that no amount of alcohol consumption is safe before a person drives. Lowering the BAC limit for drivers reinforces our culture\u2019s attitude that some drinking and driving is&#160;acceptable.<\/li>\n<li><b>It would be difficult to identify and prosecute drivers with a BAC of less than 0.08.&#160;<\/b>Some law enforcement agencies claim many drivers don\u2019t exhibit behaviors that would lead to a traffic stop at 0.05 BAC. In addition, l<b>owering the BAC level will not increase enforcement of drunk-driving laws.&#160;<\/b>\u00a0Currently officers can only stop a fraction of people who drive drunk, and changing the permissible BAC for drivers will not <a href=\"http:\/\/www.npr.org\/2013\/05\/21\/185809737\/would-lowering-the-drunk-driving-threshold-help\">increase stops or arrests<\/a>.<\/li>\n<li><b>Law enforcement officers can already issue citations for someone who is driving erratically or unsafely even if their BAC is less than&#160;0.08.<\/b><\/li>\n<li><a href=\"http:\/\/www.journalgazette.net\/article\/20130521\/NEWS07\/305219938\/1067\/NEWS07\" target=\"_blank\">States had a difficult time reducing the BAC limit for drivers from 0.1 to 0.08 BAC; a further reduction is unlikely to receive the support it needs to become law<\/a>.<\/li>\n<li><b>There are far more effective ways to reduce drunk&#160;driving<\/b>, such as ignition&#160;interlocks.<\/li>\n<\/ul>\n<h3>.05 BAC Only One of 19&#160;Recommendations<\/h3>\n<p>It is important to note that lowering the BAC for drunk driving is <a href=\"https:\/\/www.scramsystems.com\/blog\/wp-content\/uploads\/2013\/06\/NTSB-Reaching-Zero-2013.pdf\" target=\"_blank\">just one of the NTSB\u2019s 19 recommendations for ending drunk driving<\/a>\u2014a recognition of the complexity of the problem. This is the first in a series of blog posts where I\u2019ll cover each of the NTSB\u2019s five safety issue areas, which&#160;include:<\/p>\n<ul>\n<li>Reducing the per se BAC limit for all&#160;drivers<\/li>\n<li>Conducting high-visibility enforcement of impaired driving laws that incorporates passive alcohol sensing&#160;technology<\/li>\n<li>Expanding the use of in-vehicle devices to prevent operation by an impaired&#160;driver<\/li>\n<li>Using DWI Courts and other programs to reduce recidivism by repeat DWI&#160;offenders<\/li>\n<li>Establishing goals for reducing impaired driving and measuring progress toward those&#160;goals<\/li>\n<\/ul>\n<p>What do you think about the arguments against lowering the legal BAC limit for drivers?
